Company shuts down ahead of federal lawsuit filed by Atlanta attorney

ATLANTA — Just days after a Channel 2 Action News investigation into a popular supplement company, they have announced they are closing their doors.

Last week, Channel 2′s Michael Seiden broke the story of an Atlanta-based attorney filing a federal lawsuit against BlackOxygen Organics for containing potentially harmful ingredients.

Representatives from the Canadian-based company told Seiden on Tuesday that they were shipping products out, but it appears that a federal lawsuit has halted those shipments for good.

Matt Wetherington, an Atlanta-based attorney, says on Tuesday he received a statement from the owners of the company that reads, in part,

“It is with a heavy heart that we must announce the immediate closing of BlackOxygen Organics.”

The statement goes on to read, “Unfortunately, the recent turn of events have forced us to make a very difficult decision, as continuing to push forward is no longer an option.”

The company claims the secret to its success started with extracting mud from a bog that is rich in fulvic acid. They then dry it and distribute it in the form of pills and powders.

The complaint filed in federal court claims the supplements contain dangerously high levels of toxic heavy metals that make them unsafe for consumption.

Wetherington said in a statement Tuesday night, “Our work is not done, and we will continue to fight to get these products out of the market and compensation to the children and families they have harmed.”

Seiden reached out to the company for comment, but has not received a response.
