Jurors go third day with no verdict in Tex McIver murder trial

ATLANTA — On Friday, it appeared jurors might be nearing a verdict in Claud “Tex” McIver murder trial. Instead, they remain deadlocked after a third full day of deliberations.

Jurors will return to the courtroom at 9 a.m. Monday to start again.

The 12-person panel is deciding the fate of the Atlanta attorney who shot and killed his wife while riding in their SUV in Sept. 2016. McIver claims the shooting was an accident, but prosecutors disagree.

On Thursday,  the judge allowed the jury to sit in McIver’s Ford Expedition for the second time, this time holding the defendant’s .38 revolver in an attempt to recreate the events of Sept. 25, 2016. Judge Robert McBurney agreed to allow it but first had to enter the vehicle into evidence, raising the ire of the defense.

“You’re just doing the work the state failed to do,” defense co-counsel Bruce Harvey said.

Earlier Thursday, jurors rewatched McIver’s interview with Atlanta police, which occurred three days after the shooting.

They had no additional requests for the judge Thursday and did not make any requests Friday until it was almost time to leave for the day.

Jurors were initially planning to leave by 4 p.m. but on Friday afternoon, they told the judge they were "making progress" and wanted to continue working toward a verdict.

They then came back 30 minutes later, saying they needed more time and would go home for the day. Deliberations will continue at 9 a.m. Monday.
