Driver to be charged in deadly high-speed wreck

COBB COUNTY, Ga. — Police are close to charging the driver of a 2009 Dodge Challenger who they say hit and killed a young father on Windy Hill Road in Smyrna Friday.%

The accident sliced the victim’s car in half.

Channel 2’s Liz Artz talked to the victim’s family Monday. Guadalupe Osornio’s family is making preparations to bury the 26-year-old man who they said leaves behind a 5-year-old son.

Osornio’s family said he was coming home from a 12-hour shift

by the orange Challenger, which  investigators said was traveling at 100 mph.

“My heart just started beating fast," Emiliano Osornio told Artz, about learning that her brother had died.

Police released a report Monday that listed David James Fuller as the driver of the Challenger. It stated Fuller ran a red light at the intersection of Windy Hill and Atlanta Roads Friday.

Dillion Ethan Gallion, 22, was listed as Fuller’s passenger. Smyrna police said both men remain in the hospital. Gallion is in serious condition, and investigators said he may not survive. %

Investigators are waiting on a search warrant to search the Challenger. They told Artz they will be looking for any indication of drinking, drug use or other evidence.

Investigators plan to charge Fuller with at least one vehicle homicide charge. That could be doubled if his passenger dies.

Fuller also faces reckless driving and serious injury by vehicle.

At the scene Friday and inside the family's Cobb County apartment, there was a growing memorial for Osornio, who was described as the backbone of his family.

"He was 26 years old. He wouldn't leave. He said he had to work and take care of the family, and buy a house. He was in the process of buying a house," close family friend Denise Williams told Artz.

Family and friends are planning a fundraiser Sunday from 1 to 5 p.m. at Brito’s Supermarket on South Cobb Drive.
