Charges announced in death of man hit while changing tire on I-85

DEKALB COUNTY, Ga. — DeKalb County police detectives are meeting with a driver who is accused of hitting and killing a man who was changing a tire on the side of the interstate.

The accident was reported about 5:30 a.m. July 13 at about 5:30 a.m. on the entry ramp to Interstate 85 north from I-285 north.

DeKalb County police said a the preliminary investigation indicated that David Wesley, 20, pulled over onto the right shoulder of I-285 to change a flat tire on the driver’s side of his car.

According to a memorial website, Wesley was on his way to work at a Buckhead Starbucks when he got the flat tire.

Police said the 21-year-old driver of a Nissan Sentra hit him. The driver remained at the scene and is now meeting with detectives to go over the charges.

Police said there was no apparent malicious intent.

"They determined that the driver had veered out of his lane of travel to where Mr. Wesley was changing his tire and struck him, resulting in his death. Charges will be taken out on that driver, failure to maintain lane and homicide by vehicle, second degree," Maj. Stephen Fore said.

Wesley was a musician from Oregon.

His family has
