DEKALB COUNTY, Ga. — A family is outraged over a judge’s sentence for a hit-and-run driver who killed a construction worker on the job. That driver took a plea deal that carries four years in prison.
The family said that’s not enough, especially since the driver admitted she was drinking and speeding.
Scottie Sherman’s family has been waiting nearly four years to find out how much time Alexis Dubose would get for hitting and killing their loved one while he was working construction on Buford Highway in Doraville.
Dubose has been out on bond the entire time.
On Thursday a judge finally sentenced Dubose to 10 years in prison with only four to serve.
“I feel like it’s a slap in the face,” Sherman’s daughter Leneesha Morton told Channel 2’s Tyisha Fernandes.
The family was shocked by the sentence since they just found out Thursday that Dubose admitted to drinking before she crossed three lanes of traffic and crashed into Sherman’s construction site.

She admitted that she was going 74 mph in a 35 mph zone and lied to police about driving the car that killed Sherman.
“The range is three to 15 years, so again, what factors suggest that the sentence should be closer to the 15 years? Was it drinking? Was it speeding? Is it hitting someone and leaving? Is it lying to police? All of those seemed like aggravated factors that require a harsher sentence,” family attorney Harold Spence said.
The DeKalb County District Attorney’s Office sent me a statement that said: “The death of Scottie Sherman was a tragedy. From the beginning, our office was in contact with his family. Prior to making any offer, our staff talked with Mr. Sherman’s family about it.”
The family said they never agreed to the deal Dubose got and they said it’s a complete miscarriage of justice.
“It showed me this world we live in is crazy and you can’t expect everybody to do the right thing,” Morton said. “If I would’ve ran her dad over, Lord have mercy Jesus, no telling what I would’ve got for that.”
Sherman’s mother told Fernandes that Sherman’s coworker called her right after Dubose hit him and just kept saying, “Let me speak to my mama.”
Those were his last words.
The DA’s office said the plea deal was offered because Dubose has no record and with this, she’s guaranteed to serve prison time.
The family is very upset over this but trying to accept it.
