Police: Man who shot at Gwinnett County delivery driver called 911 to say he shot at someone

GWINNETT COUNTY, Ga. — A delivery driver is shaken up after getting caught in the crossfire during a shooting Sunday night.

The delivery driver pulled into a gas station along Old Norcross Road just outside of Duluth after his car was hit. He was shaken but fine.

It wouldn’t take police too long to figure out who fired the bullets, because that man also came to police for help.

“I think the people confuse me with somebody. I don’t know why. You see my car,” Miguel Malpica said, showing Channel 2′s Tony Thomas the damage done to his car.

Malpica said the car was splattered with bullets after he drove into a Gwinnett County apartment complex to deliver a bag of wings.

“I’m at some complex and somebody tried to kill me,” Malpica said in a call to 911.

Luckily, he wasn’t hit himself. But what he didn’t realize is the man who shot at him was also calling for help.

“My child’s mother’s boyfriend came over here and tried to kill me and I returned fire,” the shooter told 911.

Charles Richardson says his ex’s new boyfriend drove by and opened fire from a car as he sat on a patio. Richardson said he returned fire.

“Was there any other’s vehicle that you hit?” the dispatcher asked Richardson.

“I don’t think so,” Richardson answered.

Malpica wasn’t the only one in danger, Thomas found, and police reports confirm that a metal railing was hit with at least two bullets in front of other apartments.

Gwinnett County police quickly put two and two together and charged Richardson with aggravated assault and felon in possession of a firearm.

“In my mind, I think (I’m going to) die. I think somebody (was going to) kill me. I think about my family,” Malpica said.

Jail records show Richardson remains in jail without bond.
