Evans had been out on bond for gang activity and theft by receiving in a previous incident.
Police have not said who fired the gun or if the shooting was accidental. They are working to determine if the child shot himself.
Channel 2′s Christian Jennings was at the apartment complex, where a neighbor said she saw the mother sitting on the stairs holding her child and hysterical.
“She kept saying, ‘My baby’s dead. My baby’s dead,’” the neighbor said.
Jennings learned that the district attorney’s office had filed a motion for Evans’ bond to be revoked on Nov. 20, but that motion was still pending and he hadn’t been before a judge yet.
